Address before the American Bar Association. The United States “annexed” the Hawaiian Islands in 1898 and obtained possession of the Philippines, Cuba, Puerto Rico, and Guam from Spain in 1899. Questions concerning how the Constitution of the United States applied to these new possessions were brought before the Supreme Court via several important lawsuits, which collectively became known as the “Insular Cases.” The author reviews constitutional issues raised and resolved by this body of law.
